Ricky’s Music Tuition Pty Ltd Terms and Conditions

 

1. Enrolment: Upon submission of your online enrolment form you commit to a full term of lessons as a spot is reserved for your child for that entire term. Should you enrol in the program throughout the term, lessons will be charged pro-rata.
   
   
2. Automatic re-enrolment: Re-enrolment is automatic from one term to the next as well as year to year. To opt out of lessons, you must abide by our cancellation policy as per below.
   
   
3. Cancellation: If you wish to cease having lessons, written notification of your un-enrolment must be received via email.
   To avoid incurring the full term’s fees this email must be received no later than the conclusion of Week 1 of each term.  All notifications must go directly to Ricky. Please do not tell your child’s instrument teacher or any other direct employee for your child’s school.
   If you meet the above requirements then you will be charged for any lessons completed up to the receipt of notice. If you un-enrol before the term begins there will be no charge.
   
   
4. Fees:
   1. Lessons are charged per term and are payable as one whole amount via the Pay Now link on our website. The amount payable is calculated as follows:
      The number of weeks we operate at your school [usually 10]) by The weekly lesson fee.
      Lesson prices are subject to change in the future. You will be notified ahead of any price increases.
   2. Fees are due by the second Friday of each term. Payment is accepted via credit card via the payment link on our website or via EFT into our nominated bank account. You may opt to pay for your lessons in weekly instalments, however lessons will cease should payments not be received.
   3. You agree to pay these fees in line with these terms and conditions. If fees remain unpaid for an extended period of time, legal action will be taken with all costs incurred passed on to you.
   4. As per our re-enrolment policy, you will receive an email notification from our office prior to the commencement of the school term notifying that payment is due. 
   5. Ricky’s Music Tuition is not responsible for the storage of your credit or debit card details where a third party payment system has collected these details (Stripe).
   6. You may stop or defer payment or update your card details at any time by writing to accounts@rickysmusictuition.com.au
   7. If you believe there has been an error with a payment, please email accounts@rickysmusictuition.com.au as soon as possible
      
      
5. Lessons: One lesson is scheduled for each week of the school term unless otherwise agreed with the school directly. You will be notified at the start of each term as to how many lessons are scheduled. A typical term is 10 weeks which means that 10 lessons will be delivered. Ricky's Music Tuition can provide a concert or performance opportunity in lieu of a regular lesson. Whlist concerts and performance opportunities are not compulsory, participation for students is free of charge. The concert or performance will count towards the term's lessons irrespective of if the student participates.
   
   
6. Missed lessons: If your child is absent from school, you must notify Ricky via email or SMS before school commences.
   Lessons missed due to non-attendance by your child will not be credited or refunded.
   Examples where credits and refunds will not be granted include
   - Children are at home sick
   - The child is taken out of school
   Any lessons missed due to reasons outside of the child or teacher's control will be rescheduled for another day.
   Examples where lessons will be rescheduled include:
   - School Teacher strike
   - Pupil Free Day
   - Athletics Carnival
   
   If the teacher is absent for any reason, you will be advised and lessons will be rescheduled for another day. If for any reason a lesson cannot be rescheduled, you will be provided a credit for the following term’s fees.
   
   
7. New students: Whilst the program is centred around learning and jamming with friends, if your child wishes to join a group that has a higher level of skill, your child may be required to join another group for a period of time until they are up to speed. Ricky will discuss this with you directly.
   
   
8. Required Equipment:
   1. Guitar – all students are required to purchase a tuition book ($15) and capo ($15) when they enrol. Both of these are one-off costs and are included in the cost of the initial enrolment. Should your child require an additional book or capo, please contact Ricky. Guitars will be supplied by Ricky’s Music Tuition for new students whilst they are starting out. It is recommended that you look to purchase a guitar for your child after commencing it is encouraged that they bring it each week to their lesson. If you wish to purchase a guitar for your child, please contact Ricky
   2. Drums – all students are required to purchase a tuition folder ($15). Students will also receive their first set of drumsticks ($15). These are a one off cost and included in the cost of the initial enrolment. Drums and/or Drum Pads will be provided for the lessons
   3. Keyboard – all students are required to purchase a tuition folder ($15) and will receive an additional learning material ($15). These are a one off cost and included in the cost of the initial enrolment. Keyboards will be provided for the lessons
      
      
9. Lost equipment: Ricky’s Music Tuition takes no responsibility for lost equipment or learning materials. Any equipment that the student uses in the course of the lessons is their responsibility. We strongly suggest that all of your child’s belongings are clearly marked with their name. 
   
   
10. Behaviour: It is expected that your child comes to their lesson excited to learn. Whilst fun, creativity and personal expression is encouraged, should your child become disruptive to the education and progression of the other students within the group, your child will be returned to their classroom. Ricky will contact you directly to discuss the suggested course of action.
    
    
11. Student supervision: Students are usually collected for their lesson, from their classroom and returned at the end. Students are never, for any reason, left unsupervised. All students must only come to a lesson when collected by the teacher from their classroom. No student is permitted to be in the allocated music space unless it is during their lesson. If your child’s lesson is during after school care, they will be signed out and back in accordingly.
    
    
12. Consent to photographs and videos: Ricky’s Music Tuition will occasionally use photographs of students in school newsletters, on our website or in marketing materials. By accepting these terms and condition you consent to us capturing and publishing those images without further consent or compensation. Please note, no images containing your child’s identity will be shared on social media. If you do not provide consent, please contact Ricky in writing.
    
    
13. Privacy policy: Under the Privacy Act 1988, you consent Ricky’s Music Tuition to collect personal information for the purpose of fulfilling the program delivery, communicating and marketing to you and processing and enforcing payments.
    
    
14. Liability for Loss:
    1. In accepting these Terms, you agree to release Ricky’s Music Tuition from all liability for any loss or damage (including direct, indirect, special, economic, or consequential loss) howsoever caused, suffered by you in relation to the provision of the Tuition Services.
    2. To the extent permitted by law, you agree that for any negligent act, misrepresentation, or breach of warranty under the Australian Consumer Law by Ricky’s Music Tuition, any liability for loss shall be limited to the resupply of the lesson, or reimbursement for the lesson, whichever Ricky’s Music Tuition in its absolute discretion elects.
    3. In addition to the above, you agree that where loss or damage suffered by you is due to an act, omission or negligence on your part, Ricky’s Music Tuition is not liable for the loss or damage.
       
       
15. Governing Law: The governing law of these Terms shall be the laws of the State in which the student is enrolled.
    
    
16. Interpretation: Tuition Services means lessons and music concerts.
